What is Employment Practices Liability Insurance (EPLI)?

What is EPLI?

Businesses of every size and industry are vulnerable to employment practice claims. In FY 2020, the EEOC resolved 70,804 charges of employee discrimination, securing $439.2 million for victims in both private sector and government workplaces. EPLI covers defense costs and damages related to employment-related claims, including allegations of wrongful termination, discrimination, workplace harassment and retaliation. Small businesses, without HR departments, could be more susceptible to claims.

No industry is immune.

The primary way to minimize damages in those cases is to prevent the issues from the start by educating managers and employees. Create effective interviewing and screening programs to avoid discrimination in hiring. Communicate corporate policies to ensure universal understanding. Have a path for employees to take if they are the object of harassment or discrimination by a supervisor. Document everything that occurs by company personnel and have policy in place to prevent and solve employee disputes in-house.

Most EPLI policies will reimburse a company for the costs of defending a lawsuit in court, as well as for judgements and settlements, regardless of the suit’s outcome. Without EPLI, the company/owner handles all costs, which could be substantial even before going to court. Avoiding EPLI claims is ideal, but in the event of one, the employee will know that you’re protected and that you don’t have to settle. This deters claims and gives substantial peace of mind to those that might be affected.
